準據法與管轄法院
本約定書之解釋與適用，以及與本約定書有關的爭議，均應依照中華民國法律予以處理，並以台灣台北地方法院為第一審管轄法院。

Recognition and Acceptance Clause
Hanguang Education Foundation (hereinafter the “Hanguang Foundation”) provides services (hereinafter the “Services”) of the Hanguang Foundation (http://www.hanguang.org) in accordance with these terms and conditions of service. When you use the website of Hanguang Foundation, you will be deemed to have read, understood, agreed to and accepted all provisions of this agreement. Hanguang Foundation reserves the right to amend or change the provisions of this agreement at any time. We suggest that you pay attention to these amendments and changes at all times. If you continue to use the website of Hanguang Foundation after any amendment or change, you will be deemed to have read, understood, agreed to and accepted such amendment or change. If you do not agree to the provisions of this agreement, or if the country or region in which you are located excludes all or part of the provisions of this agreement, you should immediately cease to use the website of Hanguang Foundation. Member Account Name, Password and Security
- You will inform Hanguang Foundation immediately in case of any unauthorized use of your password or account name or upon occurrence of any other security issue.
- After each connection, close the use of your account.
User’s Legal Compliance Obligation and Undertaking
- Publish or transmit on Hanguang Foundation any libelous, insulting, threatening, aggressive, inappropriate, obscene, untrue text, picture or any form of file, or any text, picture or file in violation of public order or good customs, or any other illegal text, picture or file;
- Damage other person’s reputation, privacy, trade secret, trademark, copyright, patent, other intellectual property right and other rights;
- Violate any confidentiality obligation owed in accordance with law or contract;
- Fraudulently use other person’s name to user the Services;
- Transmit or distribute computer viruses;
- Engage in any illegal transaction or publish any untrue and crime-enticing message;
- Sell guns, narcotics, prohibited drugs, pirated software or other contraband;
- Provide gambling information or entice other persons to participate in gambling in any manner;
- Abuse of emails to distribute advertisements;
- Other acts that Hanguang Foundation justifiably considers inappropriate.

Maintaining the confidentiality and security of your password and account name is your responsibility.
You will be fully responsible for all acts engaged through use of such password and account name. You also agree to the following:
You undertake never to use Hanguang Foundation for any illegal purpose or use it in any illegal manner. You undertake to comply with relevant legislations of the Republic of China and all international customs for use of the Internet. If your use is outside the Republic of China, you also agree to comply with the legislations of the country or region where you are located. You agree and guarantee not to use the Services to engage in any act of infringement of any other person’s right or breach of law, including but not limited to:
The Services may encounter interruption or breakdown at times, which may cause inconvenience for your use, loss of information, errors, unauthorized alteration or other economic losses. It is advisable that you take protective measures when using the Services. Hanguang Foundation will not be liable for any damage caused by your use (or inability to use) the Services.
Hanguang Foundation does not bear any liability of warranty for any software or information that you download from the use of the Services or from other websites linked to Hanguang Foundation. The Services consist of the provision of various online information services to the members of the website through the Internet and cannot guarantee the completeness or correctness of the information that you transmit or save on the platform of the Services. You should be aware and agree that the Services will not be liable for any loss of data that you transmit or save. If you discover any error or omission in any function or system provided by the Services, please notify the system administrator of the Services immediately. We also suggest that you back up your information on a regular basis.
Hanguang Foundation will not guarantee that the information or suggestion acquired from your use of the Services or other websites linked to Hanguang Foundation (including but not limited to business, investment, medical and legal) are entirely correct. Hanguang Foundation has the right to make changes or delete any information or suggestion provided under the Services. Before you make any relevant planning and decisions, please consult professional staff to provide advice on your situation in order to suit your individual requirements.
Hanguang Foundation will cooperate with third parties such as other companies and suppliers (hereinafter “Content Suppliers”) at any time. If the Suppliers provide any news, messages or newsletters that are displayed by Hanguang Foundation, Hanguang Foundation will identify the Content Suppliers at the time of display. All advertising content, descriptions by text or pictures, display of samples or other marketing information that you view on Hanguang Foundation are designed and provided by the relevant advertisers and suppliers of products and services. You should exercise your own discretion and judgment about the correctness and reliability of any advertisement. Hanguang Foundation only accepts to display the advertisement and will not bear any liability of warranty for such advertisement.
Suppliers or individuals may user the Services or other websites linked to Hanguang Foundation to engage in product trading, services or other transactions. If you engage in any transaction with such supplier or individual, such trading or other agreement only exists between you and such supplier or individual. You should require such supplier or individual to provide prior detailed explanations and descriptions about the quality, content, shipping, guarantee matters and defect warranty liability for their products, services or other transacted properties. In case of any dispute arising out of such trading, services or other transaction, you should seek remedy or resolution from such suppliers or individuals. Any data, information, text, software, music, ring tone, picture, graphic, visual image, message or other information publicly posted or transmitted in private by any member (hereinafter “Member Content”) is under the responsibility of the provider of the Member Content. Hanguang Foundation cannot control Member Content posted through the Services, and thus does not guarantee its correctness, completeness or quality. You understand that, in using the Services, you may come in contact with Member Content that is unpleasant, inappropriate or undesirable. In all circumstances, Hanguang Foundation will not be liable for any Member Content, including but not limited to any error or omission, nor will it be liable for any loss or damage incurred from the posting, sending of emails or transmission through the Services.
You understand that Hanguang Foundation does not perform prior review of Member Content. However, Hanguang Foundation has the right (but not the obligation) to reject or remove any Member Content provided through the Services at its own discretion. Without prejudice to the foregoing, Hanguang Foundation and its designated persons are entitled to remove any Member Content that is in violation of the terms and conditions of the Services or any undesirable Member Content. In using Member Content, you agree that you should perform your own assessment and bear all risks with regard to the correctness, completeness or practicability of the above-mentioned Member Content. You understand and agree that Hanguang Foundation may keep or disclose any Member Content to any government or judicial authority, police or guardian of a minor in accordance with legal requirements or as reasonably required for the following purposes:
The intellectual property rights of any software or program used by Hanguang Foundation and all content on the website, including but not limited to any written work, picture, file, data, information, website structure, website layout, or web page design are legally held by Hanguang Foundation or other rights holders, including but not limited to trademark rights, patent rights, copyright, trade secrets and know-how. For the sake of public interest, Hanguang Foundation will provide relevant information to teachers for educational purposes. No one is allowed to make any commercial use, alteration, reproduction, public broadcast, adaptation, dissemination, publication, reverse engineering, de-composition or de-compilation thereof. If you wish to use or transfer such software, program or website content, you must acquire prior written consent from Hanguang Foundation or the other rights holders. Respecting intellectual property rights is your obligation. In case of any violation, you will be liable to Hanguang Foundation for compensation (including but not limited to litigation fees and attorney fees).
If you do not have the legal right to make any authorized use, revision, reproduction, public transmission, adaption, dissemination, publishing or publication of any information and to assign such right to any third party, please do not upload, transmit, key in or provide such information to Hanguang Foundation. Once you upload, transmit, key in or provide such information to Hanguang Foundation, it shall be deemed that you have given authorization to Hanguang Foundation to unconditionally use, revise, reproduce, publicly broadcast, adapt, disseminate, issue and publish such information for any public or private purpose and to further assign such rights to any other person, without any objection from you. You also guarantee that Hanguang Foundation’s use, revision, reproduction, public broadcast, adaptation, dissemination, issuance, publication and further authorization of such information will not infringe upon any third party’s intellectual property rights, otherwise you will be liable for compensating Hanguang Foundation (including but not limited to litigation fees and attorney fees).
You agree that Hanguang Foundation may, based on its own consideration and for any reason, including but not limited to lack of use, or because Hanguang Foundation considers that you have violated the provisions or the spirit of the terms and conditions of the Services, terminate your use of the password, account name (or any part thereof) or the Services and may remove and delete any “Member Content” under the Services. Hanguang Foundation may also, based on its own consideration, with or without notice, terminate the Services or any part thereof at any time. You agree that the Services provided in accordance with any provision under the terms and conditions of the Services may be terminated immediately. You recognize and agree that Hanguang Foundation may immediately close or delete your account name as well as all relevant information and files under your account and stop your use of the Services. In addition, you agree that if use of the Services is terminated, Hanguang Foundation will not bear any liability to you or any third party.
The interpretation and application of this agreement, as well as any dispute in relation to this agreement, shall be governed by the laws of the Republic of China. The Taiwan Taipei District Court shall be the first-instance court of jurisdiction.
